Probate Guidance for Northern Arizona Families

Helping Northern Arizona Families Avoid Probate When Possible


With proper planning, some assets may transfer outside of probate. We assist clients with beneficiary deeds, trust planning, and property transfers, including transferring real estate into trusts to help avoid probate in Arizona.


For homeowners buying or selling property, estate planning is especially important. We frequently help clients update their estate plans after major life events such as marriage, divorce, purchasing a home, or welcoming a new child.

Arizona Small Estate Process (Real Property & Personal Property)


Arizona law provides a simplified probate alternative known as the Small Estate process, which allows heirs to transfer assets without going through full probate court. This process can save time, money, and stress after the death of a loved one.

Small Estate for Personal Property (A.R.S. § 14-3971)

Personal property, such as bank accounts, vehicles, refunds, wages, and personal belongings, may be transferred using a Small Estate Affidavit if:


  • The total value of the personal property is $200,000 or less (excluding liens), and
  • At least 30 days have passed since the date of death.


No court hearing is required. The affidavit is presented directly to the bank, financial institution, or asset holder.

Small Estate for Real Property (A.R.S. § 14-3971)

Arizona also allows a simplified process for real estate, such as a home or land, if:


  • The total value of Arizona real property is $300,000 or less (equity only), and
  •  At least 6 months have passed since the date of death.


In these cases, heirs may file a Small Estate Affidavit for Real Property with the court and record it with the county recorder to legally transfer title, often without opening probate.
